തന്നെ വ്യക്തിഹത്യ ചെയ്യാനായി കരുതിക്കൂട്ടിയുണ്ടാക്കിയ വ്യാജ പരാതിയാണിതെന്നാണ് പി.ടി. കുഞ്ഞുമുഹമ്മദിന്റെ വാദം. സംഭവം നടന്നു എന്ന് പറയുന്ന തീയതി കഴിഞ്ഞ് 20 ദിവസങ്ങൾക്ക് ശേഷം പരാതി നൽകിയതിലെ ദുരൂഹത പ്രതിഭാഗം അഭിഭാഷകൻ കോടതിയിൽ ചൂണ്ടിക്കാട്ടി. നല്ല വിദ്യാഭ്യാസവും സാമൂഹിക ബോധവുമുള്ള പരാതിക്കാരി എന്തിനാണ് നിയമനടപടി സ്വീകരിക്കാൻ ഇത്രയധികം വൈകിയതെന്നാണ് പ്രതിഭാഗത്തിന്റെ പ്രധാന ചോദ്യം. തന്റെ കക്ഷിയുടെ സൽപ്പേരിന് കളങ്കമുണ്ടാക്കാനുള്ള ഗൂഢാലോചനയാണ് ഇതിന് പിന്നിലെന്നും അവർ ആരോപിച്ചു.

എന്നാൽ, പ്രതിഭാഗത്തിന്റെ വാദങ്ങളെ പ്രോസിക്യൂഷൻ ശക്തമായി എതിർത്തു. സമൂഹത്തിൽ വലിയ സ്വാധീനമുള്ള ഒരാളിൽ നിന്നുണ്ടായ അതിക്രമം പരാതിക്കാരിയെ കടുത്ത മാനസികാഘാതത്തിലേക്കാണ് തള്ളിവിട്ടതെന്ന് പ്രോസിക്യൂഷൻ കോടതിയെ അറിയിച്ചു. ഈ ഞെട്ടലിൽ നിന്ന് മുക്തയാകാനും കുടുംബവുമായി കൂടിയാലോചിച്ച് പരാതിയുമായി മുന്നോട്ട് വരാനും സമയം എടുത്തതിനെ സംശയത്തോടെ കാണാൻ കഴിയില്ല. പ്രതിയുടെ പദവിയും അധികാരവും കണക്കിലെടുത്ത് ഇയാളെ കസ്റ്റഡിയിൽ ചോദ്യം ചെയ്യേണ്ടതുണ്ടെന്നും അതിനാൽ മുൻകൂർ ജാമ്യം അനുവദിക്കരുതെന്നും സർക്കാർ അഭിഭാഷകൻ ആവശ്യപ്പെട്ടു.
